ACCEPTANCE OF TERMS

By accessing or using the EasyLandly platform, mobile application, or services (“Services”), you agree to be bound by these Terms of Use and all applicable laws and regulations.
If you do not agree, do not use or access the Services.

Use of EasyLandly constitutes a binding agreement between you (“User,” “Agent,” “Vendor,” or “Customer”) and EasyLandly Limited.

NATURE OF SERVICE

EasyLandly provides an online marketplace for listing, discovering, renting, leasing, or selling real estate properties globally.
EasyLandly does not own, operate, or control any property listed on the platform and is not a real estate agency, broker, or guarantor of any transaction.

All listings, descriptions, images, and representations are provided solely by third-party vendors, agents, or property owners.

USER ELIGIBILITY

You must be at least 18 years old and capable of entering into binding contracts to use the Services.
Users agree to provide accurate information during registration and maintain the confidentiality of their credentials.
You are solely responsible for all activities under your account.

ACCOUNT CREATION & VERIFICATION

1. Vendors/Agents must complete Know-Your-Customer (KYC) verification, including valid National Identification Number (NIN), ID card, and (where applicable) face verification.
2. EasyLandly reserves the right to approve, suspend, or terminate any account at its discretion.
3. EasyLandly may refuse registration or listing if the supplied information is false, incomplete, or unverifiable.

USER RESPONSIBILITIES AND CONDUCT

Users and vendors agree to:

• Provide truthful and accurate listing information.
• Upload only lawful images or content they have rights to.
• Avoid duplicate, misleading, fraudulent, or counterfeit listings.
• Respect intellectual property and privacy rights of others.

You may not:

• Use the Services for illegal activities, scams, or money laundering.
• Circumvent the platform’s payment systems.
• Distribute malware or attempt to gain unauthorized access.

LISTINGS AND TRANSACTIONS

• Listings remain the sole responsibility of the vendor who created them.
• EasyLandly does not guarantee the existence, quality, safety, legality, or accuracy of any property or advertisement.
• EasyLandly is not a party to any transaction between buyers, tenants, agents, or developers.
• Any negotiation, agreement, or payment between users is entirely at their own risk.

PAYMENTS AND FEES

• Agents or vendors may be charged fees for subscriptions, tokens, featured listings, or verification.
• Fees are non-refundable except where required by applicable law.
• Payments are processed via secure third-party gateways (e.g., Paystack).
• EasyLandly does not store payment card details.
• All fees are subject to change with prior notice on the platform.

TICKET OR TOKEN ACCESS

Some information (e.g., contact details of property owners) may be accessible only through paid tokens or tickets.
Tokens grant temporary access rights only; they are non-transferable and non-refundable once used.

VERIFICATION AND RATING SYSTEM

• Vendors may obtain “Verified” badges upon successful identity and property verification.
• Verification does not constitute endorsement, warranty, or guarantee by EasyLandly.
• Users are encouraged to exercise due diligence before entering any transaction.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law:

• The Services are provided “as-is” and “as-available.”
• EasyLandly makes no warranties, express or implied, regarding the Services, listings, or outcomes.
• EasyLandly disclaims all responsibility for inaccuracies, delays, service interruptions, or third-party errors.
• EasyLandly does not guarantee the completion, legality, or safety of any property deal initiated on the platform.

LIMITATION OF LIABILITY

In no event shall EasyLandly Limited, its directors, employees, affiliates, or partners be liable for any:

• Loss of profits, revenue, goodwill, or data;
• Property loss, damage, injury, or fraud by a vendor;
• Technical failure, downtime, or data breach caused by third-party service providers;
• Any indirect, consequential, or punitive damages arising out of the use or inability to use the platform.

Your sole remedy is to discontinue use of the Services.
Liability, if any, shall not exceed the amount paid by you to EasyLandly in the preceding 12 months.

INDEMNITY

You agree to indemnify, defend, and hold harmless EasyLandly Limited, its officers, partners, and affiliates from all claims, losses, liabilities, and expenses (including legal fees) arising from:

• your use or misuse of the Services;
• violation of these Terms or applicable law;
• infringement of any third-party right;
• false or fraudulent listings.

INTELLECTUAL PROPERTY

All platform code, graphics, logos, and trademarks are property of EasyLandly Limited.
Users retain ownership of their submitted content but grant EasyLandly a non-exclusive, worldwide, royalty-free license to display and distribute it for marketing and operational purposes.

DATA PROTECTION & PRIVACY

• EasyLandly complies with the Nigeria Data Protection Regulation (NDPR 2019) and international data standards.
• Personal data is processed solely for legitimate business purposes.
• Users can request access, correction, or deletion of their data per NDPR rights.
• See also the EasyLandly Privacy Policy (to be published separately).

THIRD-PARTY LINKS AND SERVICES

The platform may contain links to third-party websites or payment providers.
EasyLandly is not responsible for the content, policies, or security of any third-party service.
Use them at your own risk.

SUSPENSION AND TERMINATION

EasyLandly may suspend or terminate any user account, without prior notice, if:

• the user violates these Terms;
• fraudulent or illegal activity is detected;
• required by law enforcement.

All outstanding fees remain payable upon termination.

GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed under the laws of the Federal Republic of Nigeria.
Any dispute shall first be resolved amicably; if unresolved, it shall be referred to arbitration in Lagos, Nigeria, conducted in English under the Arbitration and Conciliation Act.
The arbitral award shall be final and binding.

FORCE MAJEURE

EasyLandly shall not be liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, internet failures, or governmental actions.

SEVERABILITY

If any provision of these Terms is found invalid, the remaining provisions remain in full force and effect.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and EasyLandly Limited and supersede all prior understandings or communications.
EasyLandly may update these Terms at any time; continued use of the platform signifies acceptance of the updated version.
